The end-user license agreement for Klay, what the software does and does not collect, and the open-source components it is built on.
This end-user license agreement (“EULA”) provides you with a license to use Klay (the “Software”) and contains warranty information and liability disclaimers. By downloading and/or using the Software, you agree to be bound by the terms of this agreement. The Software is protected by copyright law and international copyright treaties, as well as other intellectual-property laws and treaties. The Software is licensed, not sold.
“Licensor” means the copyright owner of Klay, or an entity authorised by the copyright owner, that is granting this license.
“You” (or “Your”) means an individual or Legal Entity exercising the permissions granted by this license.
“Legal Entity” means any company, organisation, association or authority using the Software for commercial purposes, together with any entity that controls, is controlled by, or is under common control with it.
“License Key” means a valid key issued by the Licensor, bought in accordance with this EULA, that unlocks the paid features of the Software.
“Your Work” means everything you create with the Software: sculpts, meshes, paint, scenes, renders, stamps, materials, and the files that hold them.
This EULA is a legal agreement between You and the Klay development team. It governs your acquisition and use of the Klay software, whether you downloaded it for free, bought a License Key, or acquired it as a Legal Entity.
By installing or using the Software you confirm that you accept these terms. The terms also apply to any update, supplement or support service for the Software, unless other terms accompany those items on delivery.
The Licensor grants You a limited, non-exclusive, non-assignable, non-sublicensable, revocable license to use the Software in accordance with this EULA.
3.1 Free use. You may download, install and use the Software without a License Key, for as long as you like. It is the full application, not a trial, and there is no time limit. Exporting your work out of the Software in third-party formats is the feature that requires a License Key.
3.2 Paid licenses. An Artist License Key is a single payment tied to one machine and includes every update through version 1. A Studio License Key is a monthly subscription that can move between machines and includes every update while it runs. A Legal Entity needs one License Key per person using the Software.
3.3 Installation. You may install the Software on any supported operating system and make copies for backup. You are responsible for making sure your machine meets the minimum requirements.
3.4 Restrictions. You agree to abide by all applicable laws when using the Software. You may not:
3.5 Education. Schools and educational institutions may copy and distribute the free Software for teaching.
Klay is in active development and is offered as pre-release software. By using it you acknowledge that:
Save often. Keep backups of Your Work.
The Software, including its code, design, graphics, logos, icons, brushes, stamps, materials and default assets that ship with it (“Licensor’s Content”), is owned by the Licensor and its licensors and is protected by copyright, trademark and other intellectual-property law.
You may not copy, modify, republish or distribute Licensor’s Content except as this EULA allows. The Klay name, logo and associated marks may not be used without prior written permission.
Assets that ship with the Software may be used freely inside Your Work, including commercial work.
6.1 Your Work is yours. The Licensor claims no ownership, license or rights of any kind over anything you create, import or export with the Software.
6.2 The Software processes Your Work locally, on your machine. Nothing you make is uploaded to any server operated by the Licensor, except the artist page, the exhibitions and the library assets you choose to publish from an artist account (7.11, 7.12, 7.15).
6.3 You are solely responsible for keeping backups of Your Work. The Licensor is not responsible for any loss, corruption or damage to it.
The Software sends a small amount of technical usage information (the “usage ping”) so the Licensor can see which versions, systems and licenses are in use and how often the Software crashes, and — when a session ends unexpectedly — a short technical excerpt of that session’s log. It never includes your scenes, files, file names, or anything you make with the Software: the excerpt has file paths, file names, folder names, your user name and any quoted name removed on your computer, before it is sent.
7.1 License Keys are verified offline, on your device, with a public-key signature. The Software does not need an internet connection to run or to check a key.
7.2 The usage ping contains: a random installation identifier created on your device; the Software’s version; your operating system and its version; your graphics card model, driver version and video memory; your number of CPU threads and amount of installed memory; the resolution and display scaling of the monitor the Software is shown on, how many monitors are connected, and the interface scale in use; your license tier, license number, machine key and a one-way fingerprint of your License Key (never the key itself); and when each session starts, how long it lasts, and whether the previous session ended cleanly.
7.3 If you have a License Key, the usage ping is linked to your license (through the license number and machine key), and therefore to the name and email address given at purchase. Without a license, it is identified only by the random installation identifier.
7.4 The server records the country your connection comes from, as derived by the hosting provider; your IP address itself is not stored. Usage data is kept for 18 months and then deleted; crash reports are kept for 90 days.
7.5 If a session ends unexpectedly, the next launch sends a crash report: the same identifiers as the usage ping, a technical excerpt of the previous session’s log (at most 16 KB — the Software’s own start-up details, its warning and error messages, and the last part of the log), a technical signature of the fault, and counts describing the scene’s size (how many layers and triangles, video memory in use, which tool was active, how long the session had run). No scene, file, file name, folder name or user name is included: they are removed on your computer before the report is sent. Crash reports are covered by the same Settings → Privacy switch and are deleted after 90 days.
7.6 The usage ping is on by default. You can turn it off at any time in the Software under Settings → Privacy: nothing is sent after that, and any events or crash report waiting to be sent are deleted. Sending never delays or blocks the Software, and it works offline; waiting events are sent at a later launch.
7.7 At launch the Software also checks klaysculpt.com for a newer release and reads the list of Klay and Community library assets. These requests carry no identifier.
7.8 When you buy a License Key, the purchase is handled by our payment provider (Stripe) under its own terms and privacy policy; your card details go to Stripe only. The Licensor receives the email address, the name you choose for the license and the machine key, which are needed to issue and deliver your key and to provide support.
7.9 The Licensor does not sell user information. It is processed on the Licensor’s behalf only by the service providers that run this website and its services: Vercel (hosting and picture storage), Neon (database), Cloudflare (scene and asset storage), Stripe (payments) and Resend (email).
7.10 To see or delete the data held about you or your license, contact the Licensor through this website.
7.11 An artist account is optional. Signing in from the Software uses your License Key, your machine key and a one-time code sent to your email address. The Licensor then stores: that email address, your license number, tier and licensee name, the machine key of each signed-in computer, a one-way fingerprint of your License Key, and the artist page you write (name, city, tagline, biography, website, Instagram name, year and pictures). The artist page is published on klaysculpt.com and in the Software’s Exhibitions gallery as soon as you save it. You can also sign in on klaysculpt.com/artist with your email address and the same one-time code. So that this works, the Licensor holds on klaysculpt.com a copy of its license records: the email address, license number, tier, licensee name, expiry date and status of each license. Website sign-in sets one session cookie, which is strictly necessary for the signed-in page, is used for nothing else, and expires after 30 days or when you sign out. To limit repeated sign-in attempts, the Licensor keeps a salted one-way hash of the network address a website sign-in came from for at most one day; the address itself is not stored.
7.12 Exhibitions you publish from an artist account, with their title, year, medium, statement and thumbnail, appear on your artist page on klaysculpt.com and in the Software’s Exhibitions gallery as soon as you publish them, without prior review. The Licensor may hide or remove any published exhibition, may stop an account from publishing, and may choose exhibitions to feature in the main gallery. The storage available to each account is limited; your limit is shown on your artist page. You can add storage with a paid plan, billed monthly or yearly through Stripe, which renews automatically until you end it. You can change or end a plan at any time on your artist page; an ended plan stays in effect until the end of the period already paid, and periods already paid are not refunded except where the law requires it. When a plan ends, your published exhibitions stay online, but you cannot add new ones while your account uses more than its limit. For a plan, the Licensor stores the plan, its billing period and status, and the identifiers Stripe gives your customer record and subscription; your card details are handled by Stripe and never reach the Licensor. An exhibition you remove leaves the gallery at once and is deleted from storage 30 days or more later, unless the Licensor features it. Uploads that are never published are deleted 30 days or more after they were sent.
7.13 You can delete your artist account at any time from the Software or on klaysculpt.com/artist. Your account, your artist page, your sign-ins, your exhibitions and your library assets leave the gallery and the library at once. So that an account deleted by mistake, or by someone else, can be recovered, the deleted data (your account details, your artist page and its earlier versions, and your exhibition files) is kept for 30 days and then erased; the same 30 days apply to an exhibition you remove and to a file you replace. We send a short notice to your email address when your account is deleted, or when several exhibitions are removed within an hour. Exhibitions the Licensor features in the main gallery may remain there until the Licensor removes them.
7.14 Downloads of exhibitions from klaysculpt.com are counted per day to show a visitor count, using a salted, irreversible hash of the connecting address; the address itself is not stored.
7.15 From an artist account you can also upload assets (such as stamps, textures, matcaps, HDRIs, light profiles and presets) to the Klay library. By uploading an asset you confirm that you made it, or hold the rights to share it, and you allow every user of the Software to download it and use it in their own work. An asset appears in the Software’s library, with your artist name and the name, category, tags, description and thumbnail you give it, as soon as you upload it, without prior review. The Licensor may hide or remove any asset, may stop an account from uploading, and may choose assets to feature. Assets count toward your account’s storage. An asset you withdraw leaves the library at once and is deleted from storage 30 days or more later; copies other users already downloaded stay on their computers. Downloads of assets are counted per day to show a download count, in the same way as exhibitions (7.14); the connecting address itself is not stored.
Klay’s sculpting, rendering and painting code is original work. The application is built on the open-source components below, each subject to its own license. Full license texts ship in the Software’s installation directory.
